April 2017 Minutes

The Farmerville Town Council met in regular session at Farmerville Town Hall, located at 407 South Main Street, Farmerville, Louisiana.

The council members present were Mayor M. Stein Baughman, Jr., Aldermen Jerry Taylor, Lavelle Maine, Caroline Gatson, Ricky Johnikin, and Robert Allen.

The roll was called and with a quorum present Mayor Baughman called the meeting to order.

At this time Mayor Baughman offered the public the opportunity to voice their opinion on all agenda items.

On motion by Gatson, seconded by Maine and unanimously approved to approve the minutes from the March 13, 2017, regular meeting.

On motion by Taylor, seconded by Gatson and unanimously approved to approve the payables for March.

On motion by Allen, seconded by Taylor and unanimously approved to accept the low
bid of $936,341.50 from T. L. Construction, LLC, for Eagle Point Drive Reconstruction Project and authorize the mayor to sign all necessary documents pertaining to project.

On motion by Taylor, seconded by Allen and unanimously approved to authorize mayor to sign substanial completion on the Boots Road TIFF Project.

A public hearing was held at this time to hear the views and opinions of citizens concerning the adoption of Ordinance No. 01-17 pertaining to occupational license refunds.

On motion by Taylor, seconded by Gatson and unanimously approved to adopt Ordinance No 01-17 pertaining to Occupational License Refunds.

ORDINANCE #01-17

AN ORDINANCE TO AMEND THE CODE
OF THE TOWN OF FARMERVILLE
BY ADDING SECTION 10-14 PROVIDING FOR
REFUND OF OVERPAID OCCUPATIONAL LICENSE TAXES

WHEREAS, the Town Council of the Town of Farmerville desires to amend the Code of Ordinances of the TOWN OF FARMERVILLE, LOUISIANA, to amend CHAPTER 10, ARTICLE 1, by adding SECTION 10-14 pertaining to the Refund of the overpayment of Occupational License Taxes.
BE IT ORDAINED by the TOWN COUNCIL of the TOWN OF FARMERVILLE, that CHAPTER 10, ARTICLE 1, of The Code of Ordinances of the TOWN OF FARMERVILLE, LOUISIANA, is hereby amended to add SECTION 10-14, to-wit:

Sec. 10-14. Refunds and reimbursements
Where no question of fact or law is involved, and it appears from the records of the governing body that occupational license taxes have been erroneously or illegally collected from any person or legal entity or have been paid by any person under a mistake of fact or law, the collector of municipal taxes may, upon making a record in writing, stating the reasons therefore, certify that a person is entitled to a refund for the current and the two (2)year tax periods prior to the current tax period the overpayment is claimed in or discovered, provided that the collector shall first apply any refund amounts to any and all amounts owed to the TOWN OF FARMERVILLE under this Chapter for the same current and prior tax periods, and thereupon the collector shall authorize the payment thereof from any appropriation available for such purpose.
NOW THEREFORE BE IT ORDAINED, that if any provision in this Ordinance shall be held to be invalid, such invalidity shall not affect other provisions herein which can be given effect without the invalid provision and to this end the provisions of this ordinance are hereby declared to be severable.

A puplic hearing was held at this time to hear the views and opinions from citizens concerning the adoption of Ordinance No 02-17 pertaining to Sewer rates for out of town industrial customers.

On motion by Taylor, seconded by Allen and unanimously approved to adopt Ordinance No 02-17 pertaining to sewer rates for out of town industrial customers.

 

ORDINANCE #02-17

AN ORDINANCE TO AMEND THE CODE
OF THE TOWN OF FARMERVILLE
BY AMENDING SECTION 9-69 PERTAINING TO INDUSTRIAL SEWER RATES
AND
BY ADDING SECTION 9-74 PROVIDING FOR
ACCEPTING DOMESTIC WASTE FROM SEPTIC TANK HAULERS

WHEREAS, the Town Council of the Town of Farmerville desires to amend the Code of Ordinances of the TOWN OF FARMERVILLE, LOUISIANA, to amend CHAPTER 9, ARTICLE 3, BY ADDING section 9-69(a)(4) pertaining to Industrial Sewer Rates and by adding SECTION 9-74 pertaining to Accepting Domestic Waste from Septic Tank Haulers.
BE IT ORDAINED by the TOWN COUNCIL of the TOWN OF FARMERVILLE, that CHAPTER 9, ARTICLE 3, of The Code of Ordinances of the TOWN OF FARMERVILLE, LOUISIANA, is hereby amended to add SECTION 9-69(a)(4), to-wit:
Sec. 9-69 Rates and charges – Monthly service; tapping and reconnection charges.
1. The uniform monthly rates and charges for sewer services are hereby adopted as follows:

(4) The Industrial sewer rate for services outside the Town limits shall be $12.00 per 1000 gallons of water used.
BE IT ORDAINED by the TOWN COUNCIL of the TOWN OF FARMERVILLE, that CHAPTER 9, ARTICLE 3, of The Code of Ordinances of the TOWN OF FARMERVILLE, LOUISIANA, is hereby amended to add SECTION 9-74, to-wit:
Sec. 9-74. Accepting Domestic Waste From Septic Tank Haulers
Domestic waste from septic tanks deemed to be and classified the same as sanitary sewage under Section 9-40 shall be accepted by the Town of Farmerville from septic tank haulers and entered into and disposed of in the towns sewer system upon payment to the Town of Farmerville of the sum of $50.00 per truck load, subject to approval by the Town Superintendent.
NOW THEREFORE BE IT ORDAINED, that if any provision in this Ordinance shall be held to be invalid, such invalidity shall not affect other provisions herein which can be given effect without the invalid provision and to this end the provisions of this ordinance are hereby declared to be severable.

April as Fair Housing month.

On motion by Allen, seconded by Gatson and unanimously approved to adopt Resolution No 06-17 pertaining to the 2018/2019 Community Development Block Grant.

RESOLUTION NO. 06-17

RESOLUTION AUTHORIZING SUMMITAL OF F.Y. 2018/2019 LOUISIANA COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION, AND ENTERING INTO AGREEMENTS ASSOCIATED WITH ADMINISTRATION AND ENGINEERING SERVICES

WHEREAS, the Town of Farmerville (“Town”) desires to submit a fiscal year (“FY”) 2018/2019 Louisiana Community Development Block Grant (“LCDBG”) Public Facilities application for sewer improvements (the “Application”); and,

WHEREAS, the Town intends to use local funds (in order to gain an additional point in connection with the Application rating) to pay for administrative costs up to and including pre-agreement costs, administrative consultant fees, and any other administrative costs incurred by the Town associated with the Application; and,

WHEREAS, the Town intends to use local funds (in order to gain additional points in connection with the Application rating) to pay for engineering costs up to and including pre-agreement costs, basic engineering design, topographic surveying, project representation, construction phase services and any other engineering costs incurred by the Town associated with the Application; and,

WHEREAS, the Town desires to enter into an agreement with Frye Magee, LLC (“Frye Magee”), to perform all administrative consulting services associates with the Application, which includes assistance with developing the Application, and thereafter performing all administrative consulting duties following a grant award; and,

WHEREAS, the Town desires to enter into an agreement with The Riley Company (“engineer”), to perform all engineering consulting services associates with the Application, which includes assistance with developing the Application, and thereafter performing all engineering consulting services, including basic engineering design, topographic surveying, project representation, construction phase services and any other engineering costs incurred by the Town, following a grant award.

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN OF THE FARMERVILLE, LOUISIANA:


2. The Town enters into an agreement with Frye Magee to develop and submit the Application, and thereafter to perform all administrative consulting duties following a grant award.

3. The Town enters into an agreement with The Riley Company to assist with the development of the Application, and thereafter to perform all engineering consulting services, including basic engineering design, topographic surveying, project representation, construction phase services and any other engineering costs incurred by the Town, following a grant award.

4. The Mayor is authorized to execute respective agreements with Frye Magee and The Riley Company, and to execute and submit the Application, as well as all related documents, to be on such other terms and conditions as he shall deem advisable, and to do any and all things necessary and proper to carry out this Resolution and to fulfill its objectives and purposes.

5. This Resolution shall become effective upon final adoption and signature of the Mayor.
Said Resolution having been read and considered by a quorum of the Board of Alderman, a record vote was taken and the following result was had:

ABSENT: NONE


WHEREUPON, the presiding officer declared the above Resolution duly adopted in full on this 10th day of April, 2017.


On motion by Gatson, seconded by Maine and unanimously approved to approve the following overtime of $15,771.00 from the previous month.

On motion by Gatson, seconded by Maine and unanimously approved to approve the Zoning Commissions recommendation to change the zoning classification for the property belonging to Mr. Kenneth Lane West, located at 309 South West Street to R3..

There being no further business to come before the council, Mayor Baughman declared this meeting adjourned upon motion by Gatson, seconded by Maine, and unanimously approved.
