The Farmerville Town Council met in regular session at Farmerville Town Hall, located at 407 South Main Street, Farmerville, Louisiana

The Farmerville Town Council met in regular session at Farmerville Town Hall, located at 407 South Main Street, Farmerville, Louisiana, on October 14, 2019.  The council members present were Mayor M. Stein Baughman, and Alderman Jerry Taylor, Thomas Nation,  Robert Allen, Caroline Gatson, and Ricky Johnikin.

The roll was called and with a quorum present Mayor Baughman called the meeting to order.  Invocation was offered by Johnikin.
        
At this time public hearings were held to hear the views and opinions for:
1.  Ordinance No. 05-19(zoning for annexed property)
2.  Ordinance No. 06-19(cross connection/backflow prevention)
3.  Ordinance No. 07-19(bulk sewage fees/sludge)    

As state law requires, Mayor Baughman offered the public the opportunity to voice their opinion on all agenda items at this time. There were no comments.
        
On motion by Taylor, seconded by Nation and unanimously approved to approve the minutes from the September 9, 2019 regular meeting.

On motion by Taylor, seconded by Allen and unanimously approved to approve the payables from September.

On motion by Taylor, seconded by Gatson and unanimously approved to accept the monthly revenue and expenditure report as presented.

On motion by Taylor, seconded by Allen and unanimously approved to award bid to lowest bidder on the Downtown Sidewalk Project and extend the construction time to 85 working days.    

On motion by Allen, seconded by Gatson and unanimously approved to approve the extension of the engineering contract to 85 days.

On motion by Gatson, seconded by Johnikin and unanimously approved to adopt Ordinance No 05-19 pertaining to Zoning for annexed property.

ORDINANCE #05-19

AN ORDINANCE TO ZONE
PROPERTY ANNEXED BY THE TOWN OF FARMERVILLE

WHEREAS, Ordinance Number 04-19 Annexed a tract of land into the corporate limits of the Town of Farmerville, and

WHEREAS, Section 2.05 of the Zoning Ordinance, of the Town of Farmerville as codified as Appendix A to the Code of Ordinances provides that territory annexed may be zoned by ordinance after public hearing.
    
SECTION 1: BE IT ORDAINED, by the Mayor and Board of Alderman of the Town of Farmerville, Louisiana, that the following described tract of land annexed by Ordinance Number 04-19 is hereby zoned as B-2, to-wit:

ALL THAT PORTION OF THE PROPERTY DESCRIBED BELOW LYING EAST OF LA. HWY. 549 (TRUXNO HIGHWAY).
A CERTAIN TRACT SITUATED IN THE S1/2 OF THE NW1/4, N1/2 OF THE SW1/4, SW1/4 OF THE NE1/4, AND NW1/4 OF THE SE1/4 ALL BEING IN SECTION 7, TOWNSHIP 21 NORTH, RANGE 1 EAST, UNION PARISH, LOUISIANA AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS, TO-WIT:

COMMENCING AT A CONCRETE MONUMENT FOUND MARKING THE SOUTH QUARTER SECTION CORNER OF SAID SECTION, THENCE NORTH 2,732.74 FEET AND EAST 89.22 FEET TO A 5/8 INCH REBAR SET MARKING THE POINT OF BEGINNING; THENCE N89°55'18"E 42.33 FEET TO THE CENTERLINE OF LOUISIANA HIGHWAY 549; THENCE S27°49'46"W FEET ALONG SAID CENTERLINE 37.77 FEET TO THE CENTERLINE INTERSECTION OF SAID HIGHWAY AND CAMP ROAD; THENCE S6°29'47"W ALONG THE CENTERLINE OF SAID CAMP ROAD 14.27 FEET TO A COTTON SPINDLE FOUND; THENCE S5°54'47"W ALONG SAID CENTERLINE 119.87 FEET; THENCE S7°55'28"W ALONG SAID CENTERLINE 483.55 FEET TO THE CENTERLINE INTERSECTION OF CAMP ROAD AND MILL ROAD; THENCE S67°12'43"W ALONG THE CENTERLINE OF SAID MILL ROAD 236.79 FEET; THENCE S69°42'05"W ALONG SAID CENTERLINE 101.09 FEET; THENCE S72°33'19"W ALONG SAID CENTERLINE 293.47 FEET TO THE CENTERLINE INTERSECTION OF MILL ROAD AND LOUISIANA HIGHWAY 549; THENCE S64°56'03"W ALONG CENTERLINE SAID HIGHWAY 111.41 FEET; THENCE S67°29'06"W ALONG SAID CENTERLINE 300.85 FEET TO THE CENTERLINE INTERSECTION OF LOUISIANA HIGHWAY 549 AND LOUISIANA HIGHWAY 15; THENCE NORTHWESTERLY ALONG THE CENTERLINE OF SAID LOUISIANA HIGHWAY 15, A CURVE ARC TO THE LEFT, ARC CENTERLINE LENGTH 1,193.16 FEET, LONG CHORD - N28°19'09"W 1,159.45 FEET, AND RADIUS OF CURVE - 1,442.80 FEET; THENCE N89°55'18"E 53.20 FEET TO A 5/8 REBAR SET; THENCE CONTINUING N89°55'18"E 1,524.68 FEET TO THE POINT OF BEGINNING; CONTAINING 19.779 ACRES, (NOT INCLUDING AREA IN RIGHT-OF-WAY), 3.700 ACRES IN RIGHT-OF-WAY, MORE OR LESS, AND BEING SUBJECT TO ANY RIGHTS-OF-WAYS, EASEMENTS OR SERVITUDES OF RECORD OR USE. TOGETHER WITH ANY AND ALL PRESENT AND FUTURE IMPROVEMENTS.

SECTION 2: BE IT ORDAINED, that if any provision in this Ordinance shall be held to be invalid, such invalidity shall not affect other provisions herein, which can be given effect without the invalid provision, and to this end the provisions of this ordinance are hereby declared to be severable.

On motion by Allen, seconded by Gatson to adopt Ordinance No. 06-19 pertaining to cross connection/backflow prevention.

ORDINANCE #06-19

AN ORDINANCE TO AMEND THE CODE OF ORDINANCES
OF THE TOWN OF FARMERVILLE
BY AMENDING SECTION 5-64 PERTAINING TO COMPLIANCE
WITH PLUMBING REQUIREMENTS

WHEREAS, the Town Council of the Town of Farmerville desires to amend the Code of Ordinances of the TOWN OF FARMERVILLE, LOUISIANA, to amend CHAPTER 5, ARTICLE IV, BY AMENDING SECTION 5-64 pertaining to Compliance with Plumbing Requirements.
BE IT ORDAINED by the TOWN COUNCIL of the TOWN OF FARMERVILLE, CHAPTER 5, ARTICLE IV, of The Code of Ordinances of the TOWN OF FARMERVILLE, LOUISIANA, is amended to add SECTION 5-64 (b) and (c), to-wit:
Sec. 5-64. Compliance Required.

(b) The Town of Farmerville will operate the Cross Connection Control/Backflow Prevention program as prescribed under State of Louisiana Sanitary Code (LAC Title 51:XII & Title 17:1) law. Any changes to the program required by regulation will automatically become part of this Section.

(c) Any consumer or other person who fails to comply with the latest revision of the International Plumbing Code, Backflow/Cross-Connection Control Requirements Sections as adopted by the Louisiana State Uniform Construction Code Council (LSUCCC), or who fails to comply with the additional requirements of this section or any notice or order made hereunder shall be in violation of this section.

NOW THEREFORE BE IT ORDAINED, that if any provision in this Ordinance shall be held to be invalid, such invalidity shall not affect other provisions herein which can be given effect without the invalid provision and to this end the provisions of this ordinance are hereby declared to be severable. All ordinances or resolutions, or parts thereof, in conflict herewith are hereby repealed.

On motion by Allen, seconded by Nation and unanimously approved to adopt Ordinance No 07-19 pertaining to bulk sewage/sludge fees.

ORDINANCE #07-19
AN ORDINANCE TO AMEND THE CODE OF ORDINANCES
OF THE TOWN OF FARMERVILLE
BY AMENDING SECTION 9-74 PROVIDING RATES FOR
ACCEPTING DOMESTIC WASTE FROM SEPTIC TANK HAULERS

WHEREAS, the Town Council of the Town of Farmerville desires to amend the Code of Ordinances of the TOWN OF FARMERVILLE, LOUISIANA, to amend CHAPTER 9, ARTICLE 3, SECTION 9-74 pertaining to Accepting Domestic Waste from Septic Tank Haulers.
BE IT ORDAINED by the TOWN COUNCIL of the TOWN OF FARMERVILLE, CHAPTER 9, ARTICLE 3, SECTION 9-74 of The Code of Ordinances of the TOWN OF FARMERVILLE, LOUISIANA, is amended as follows, to-wit:
Sec. 9-74. Accepting Domestic Waste From Septic Tank Haulers
Domestic waste from septic tanks deemed to be and classified the same as sanitary sewage under Section 9-40 shall be accepted by the Town of Farmerville from septic tank haulers as bulk sewage sludge and entered into and disposed of only at the Waste Water Treatment Plant on Downsville Street upon payment to the Town of Farmerville at the following rates, to-wit:
Up to 1000 gallons  $50.00
For each gallon over 1000, $0.05 per gallon
NOW THEREFORE BE IT ORDAINED, that if any provision in this Ordinance shall be held to be invalid, such invalidity shall not affect other provisions herein which can be given effect without the invalid provision and to this end the provisions of this ordinance are hereby declared to be severable.

On motion by Allen, seconded by Nation and unanimously approved to approve the utility payment plan policy as presented.

On motion by Allen, seconded by Nation and unanimously approved to purchase a pick up truck for the sanitation department.

On motion by Gatson, seconded by Taylor and unanimously approved to renew the lease for Union Counseling Center.

On motion by Gatson, seconded by Johnikin and unanimously approved to authorize the Union Parish High School Softball team to have a 5K fund raiser on November 2, 2019.

On motion by Gatson, seconded by Allen and unanimously approved to approve the following action taken by the Farmerville Zoning Commission:

1.  To approve the zoning change for property belonging to Willie T. Sensley, Jr located at 240 Camp Rd to R3.  
2.  To approve the zoning change for property belonging to Stevie Washington            located at 805 Hickory St to R3.   

On motion by Taylor, seconded by Gatson and unanimously approved to table the discussion on Meadowbrook Subdivision until the matter can be researched.     

There being no further business to come before the council, Mayor Baughman declared this meeting adjorned this the 14th day of October, 2019, upon motion by Nation, seconded by Gatson and unanimously approved.
