The Farmerville Town Council met in regular session at Farmerville Town Hall, located at 407 South Main Street, Farmerville, Louisiana

The Farmerville Town Council met in regular session at Farmerville Town Hall, located at 407 South Main Street, Farmerville, Louisiana, on July 8, 2019.  The council members present were Mayor M. Stein Baughman, and Alderman Jerry Taylor, Lavelle Maine,  Robert Allen,Caroline Gatson,  and Ricky Johnikin.

The roll was called and with a quorum present Mayor Baughman called the meeting to order.  Invocation was offered by Johnikin.

At this time a public hearing was held to hear the views and opinions of citizens concerning the adoption of Ordinance No. 02-19 pertaining to annexation.

At this time a public hearing was held to hear the views and opinions of citizens concerning the adoption of Ordinance No 03-19 pertaining to the zoning classification of newly annexed property.
        
As state law requires, Mayor Baughman offered the public the opportunity to voice their opinion on all agenda items at this time. There were no comments.
        
On motion by Taylor, seconded by Gatson and unanimously approved to approve the minutes from the June 10, 2019 regular meeing, June 20, 2019 special meeting and the June 24, 2019 special meeting.

On motion by Taylor, seconded by Maine and unanimously approved to approve the payables from June.

On motion by Allen, seconded by Johnikin and unanimously approved to accept the monthly revenue and expenditure report as presented.

On motion by Allen, seconded by Maine and unanimously approved to approve the operating hours for the Willie Davis Recreation Center as Monday thru Thursday from 7:00 a.m. to 8 p.m., Friday 7:00 a.m. to 5:00 p.m. and Saturday from 12:00 a.m. to 4:00 p.m.

On motion by Allen, seconded by Maine and unanimously approved to authorized to advertise for bids on outside basketball courts at the Willie Davis Recreation Center.

On motion by Taylor, seconded by Allen and unanimously approved to adopt Ordinance No 02-19 pertaining to the annexation of Edgewood subdivision and a lot on Hwy 2 West in Edgewood Subdivision.

On motion by Allen, seconded by Taylor and unanimously approved to adopt Ordinance No 03-19 pertaining to the zoning of annexed property.

ORDINANCE #3-19

AN ORDINANCE TO ZONE
PROPERTY ANNEXED BY THE TOWN OF FARMERVILLE

WHEREAS, Ordinance Number 02-19 Annexed several acres of land into the corporate limits of the Town of Farmerville, and

WHEREAS, Section 2.05 of the Zoning Ordinance, of the Town of Farmerville as codified as Appendix A to the Code of Ordinances provides that territory annexed may be zoned by ordinance after public hearing.
    
SECTION 1: BE IT ORDAINED, by the Mayor and Board of Alderman of the Town of Farmerville, Louisiana, that the following described tract of land annexed by Ordinance Number 02-19 is hereby zoned as B-3, to-wit:

A certain tract of land situated in the SE ¼ of the SW ¼ of Section 24 and the NE ¼ of the NW/14 of Section 25, all being in T21N, R1W, Union Parish, Louisiana and being more particularly described as follows, to-wit:

Commencing at a pine knot found marking the NW corner of Section 25, thence North 151.06 feet and 1,787.41 feet East to a 5/8 inch rebar set marking the POINT OF BEGINNING; thence S89°40’08”E 530.00 feet to a 5/8 inch rebar set; thence S0°19’52”W 680.00 feet to a 5/8 inch rebar set on the North right-of-way line of Louisiana Highway No. 2 (eighty foot right-of-way); thence N89°40’08”W along said right-of-way line 530.00 feet to a 5/8 inch rebar set; thence N0°19’52”E 680.00 feet to the POINT OF BEGINNING; containing 8.274 acres, more or less, and being subject to any rights-of-ways, easements or servitudes of record or use.

AND

A parcel of land situated in the Southeast ¼ of the Southwest ¼ of Section 24 and in the Northeast ¼ of the Northwest ¼ of Section 25, all in Township 21 North, Range 1 West, Land District North of Red River, Union Parish, Louisiana, more particularly described as follows:

Beginning at a found 5/8 inch rebar at the Northwest corner of that certain 8.274 acre tract conveyed to KM Group, LLC in Conveyance Book 1214, page 509 and later conveyed to GPA I, LLC in Conveyance Book 1228, page 223, said rebar being by record 151.06 feet North and 1787.41 feet East of the Northwest corner of Section 25, T21N, R1W and with this rebar as the POINT OF BEGINNING of herein described parcel, run South 0 degrees 23 minutes 31 seconds West along West line of said 8.274 acre tract for a distance of 679.96 feet (record = South 0 degrees 19 minutes 52 seconds West, 680.00 feet) to a 5/8 inch rebar found on the North right of way of Louisiana Highway No. 2; thence North 89 degrees 40 minutes 08 seconds West along North right of way of Louisiana Highway No. 2 for a distance of 50.00 feet to a ½ inch iron pipe set; thence North 0 degrees 23 minutes 31 seconds East, 679.97 feet to a ½ inch iron pipe set; thence South 89 degrees 39 minutes 49 seconds East, 50.00 feet to the POINT O BEGINNING, containing 0.780 acre and being subject to any easements, servitudes or rights of way thereon and/or of record.

ALSO

A parcel of land situated in the Southeast ¼ of the Southwest ¼ of Section 24 and in the Northeast ¼ of the Northwest ¼ of Section 25, all in Township 21 North, Range 1 West, Land District North of Red River, Union Parish, Louisiana, more particularly described as follows:

Commencing at a found 5/8 inch rebar at the Northwest corner of that certain 8.274 acre tract conveyed to KM Group, LLC in Conveyance Book 1214, page 509 and later conveyed to GPA I, LLC in Conveyance Book 1228, page 223, said rebar being by record 151.06 feet North and 1787.41 feet East of the Northwest corner of Section 25, T21N, R1W and from commencing point run South 89 degrees 39 minutes 49 seconds East along North line of said 8.274 acre tract for a distance of 529.62 feet (record = South 89 degrees 40 minutes 08 seconds East, 530.00 feet) to a 5/8 inch rebar found and the POINT OF BEGINNING of herein described parcel; thence South 89 degrees 39 minutes 49 seconds East, 50.00 feet to a1/2 inch iron pipe set; thence South 0 degrees 21 minutes 15 seconds West, 679.91 feet to a ½ inch iron pipe set on the North right of way of Louisiana Highway No. 2; thence North 89 degrees 40 minutes 08 seconds West along North right of way of Louisiana Highway No. 2 for a distance of 50.00 feet to a 5/8 inch rebar found at the Southeast corner of aforementioned 8.274 acre tract (CB 1228-223); thence South 0 degrees 21 minutes 15 seconds East along East line of said 8.274 acre tract for a distance of 679.91 feet (record = North 0 degrees 19 minutes 52 seconds East, 680.00 feet) to the POINT OF BEGINNING containing 0.780 acre and being subject to any easements, servitudes or rights of way thereon and/or of record.

SECTION 2: The property herein zoned B-3 is so zoned subject to the following conditions and provisions, to-wit:

ZONE B3 CENTRAL BUSINESS DISTRICT
With the condition that

The above described tract shall not be subdivided and any project involving the location of two or more residential structures on said tract shall comply with R-3 Residence District General provisions in Sec.7.05 (2) (a) (b)  (3) (4)
AND the following provisions.

Spacing:
1) resident lot spaces shall have a minimum area of 2688 sq.
2) residents shall be spaced 10 ft. apart, 5 ft. on each side, shall have a front yd. of not less than 18 ft. and back yard of not less than 1 ft.
3) there shall be no side or back entrance, except a side entrance to a carport or Garage underroof.
4) no shrubs, trees, plants or manmade objects can be placed between residence.
5) residence shall have a minimum of 1440 sq. ft. and must have at least 1 attached carport or garage.

SECTION 3: BE IT ORDAINED, that if any provision in this Ordinance shall be held to be invalid, such invalidity shall not affect other provisions herein, which can be given effect without the invalid provision, and to this end the provisions of this ordinance are hereby declared to be severable.
    
Introduced the 10th day of June, 2019.

After hearing conducted and reading of the above, section by section, the vote was as follows, to wit:

The ordinance was declared adopted this 8th day of July, 2019.

On motion by Taylor, seconded by Gatson and unanimously approved to approve the Legislative Audit Questionaire for 2018/2019.

On motion by Allen, seconded by Gatson and unanimously approved to approve the write of list as presented.

On motion by Gatson, seconded by Allen and unanimously approved to authorize the transfer of the 2% insurance rebate to the Farmerville Volunteer Fire Department.

There being no further business to come before the council, Mayor Baughman declared this meeting adjourned this the 8th day of July, 2019, upon motion by Gatson, seconded by Allen, and unanimously approved.
